If we accept the matter, the client receives the resources of a firm that has represented injured people since 1969 and recovered hundreds of millions of dollars across serious personal injury practice areas. Our on-staff registered nurses work with our attorneys to analyze medical records and treatment histories, understand the extent of a client’s injuries, and assess future care needs.The firm prepares cases with the expectation that trial may be necessary when a fair resolution cannot be reached.

How the Referral Process Works

  • Contact us for an initial review. Provide the names of the parties, the type and date of the incident, , a brief description of what happened and the injuries involved, and any immediate concerns.
  • We conduct a preliminary  case review. Our team considers the parties, potential deadlines, legal issues, injuries, available evidence, and whether the matter fits the firm’s practice and resources.
  • We speak with every client. We arrange a confidential consultation so the client can tell us what happened and ask questions, and when appropriate one of our registered nurses also speaks with the client to understand the medical picture.
  • We confirm the working relationship. If the firm accepts the matter, we put the representation in writing, including the referral-fee agreement, typically one-third of the attorney fee, or any co-counsel arrangement that applies.
  • We take responsibility for moving the case forward. Our team investigates the claim, preserves evidence, obtains and reviews records, consults appropriate professionals, communicates with the client, and prepares the case for resolution or trial.

Referral Fees and Co-Counsel Arrangements

Olsman MacKenzie Peacock honors referral and co-counsel fees. We recognize the role referring attorneys play in connecting clients with the right counsel, and we pay a referral fee, typically one-third of the attorney fee, in accordance with the Michigan Rules of Professional Conduct.

Michigan Rule of Professional Conduct 1.5(e) permits lawyers in different firms to divide a fee when the client is advised of and does not object to the participation of all lawyers involved, and the total fee is reasonable. We put the referral agreement in writing and advise the client in writing that a referral fee may be paid, as the rules require. The fee division comes from the attorney fee and does not increase the fee charged to the client.

The Level of Involvement Can Fit the Matter

Most attorneys prefer to refer a case and receive appropriate updates. Others want to remain involved as co-counsel, participate in strategy, assist with discovery, attend depositions, or help prepare for trial. We can discuss the appropriate role at the beginning of the relationship and document the arrangement so responsibilities and communication expectations are clear.

Whatever the arrangement, the client’s interests come first. The client should understand which attorneys are participating, who is responsible for the matter, and whom to contact with questions.

Attorney Referral FAQs

Does OMP consider referral-fee arrangements?

Yes. We honor referral fees. We pay a referral fee, typically one-third of the attorney fee, in accordance with MRPC 1.5(e). We put the agreement in writing and advise the client in writing that a referral fee may be paid and of the lawyers participating in the matter.

Can I remain involved after referring the case?

Yes, and how involved you stay is entirely up to you. Most referring attorneys hand the case to us and step back, receiving updates as it progresses. Others prefer to stay on as co-counsel, take part in strategy, or join depositions and trial preparation. We tailor the arrangement to what you want and document it at the outset.

Will you keep me updated on the case?

Yes. We reach out at meaningful milestones with where the case stands and what comes next, and you are welcome to contact us anytime in between. You will not have to wonder about the status of a case you referred to us.

What information should I provide for the initial review?

To start, just the client’s name and contact information. From there, we handle the rest, including deadlines and evaluation of the claim. If we need anything else, we will ask.

What if I am not sure whether OMP handles the type of case?

Contact us. We can conduct an initial review and tell you whether the case fits our practice. If it does not, we will say so promptly, and most of the time we can point you toward another attorney who may be able to help.

Does submitting a referral create an attorney-client relationship?

No. Sending information through the website or speaking with the firm for an initial review does not establish an attorney-client relationship. Representation begins only after the firm and client enter a written agreement.
