Another reason why damages caps are a risk to patient safety. Damage caps are arbitrary limits on the compensation that someone who is injured by a medical provider can recover.

In Michigan, if a patient is killed as a result of medical negligence, the cap on non-economic damages is $455,000. Our legislature has determined that $455,000 as the flat rate for value of a human life in Michigan.

According to a study performed by the Journal of the American Medical Association (JAMA), cardiologists tolerate greater clinical uncertainty in coronary artery disease testing and treatment if they face lower malpractice risk.

Our legislature should seriously reconsider these arbitrary caps on damages to promote quality care for every person in our state.
